摘要：野外探险是一项高风险运动,随着野外探险活动种类、区域及其参加者日益增多,遇险救援事件也呈日益多发趋势,野外探险规范和救援制度缺失问题亟待解决。根据有关国家和地区的经验,有效的野外探险救援机制应当以法律规范为基础,预防预警为保障,政府救援为主导,民间救援为辅助。以此为鉴,从法律视角看,应当尽快建立我国野外探险救援机制,重点是建立健全野外探险及遇险救援法律规范体系,采取有效的野外探险预防预警制度安排,构建契合国情的野外探险救援组织体系。
Outdoor expedition is a high risk sport. As the type, scope and participator of outdoor expedition increased, the sport incidents increased too, and the problem of outdoor expedition management and rescue mechanism lacking become urgent. According to the experience of some country and area, effective outdoor expedition rescue mechanism should base on law and precaution, as well as government and private rescue. According to this, China should set up outdoor expedition rescue mechanism, which include making legislation system, establishing rescue precaution mechanism, perfecting rescue organization.
