摘要：京津冀文化遗产保护与利用区域协同法律治理承载着疏解非核心功能与突出首都核心功能的目标,但是须直面区域性立法法律位阶不明与文化遗产立法零散并存、解决急需问题立法的优先顺位与解决长远问题劣后立法关系、遗产资源禀赋差异与行政力量强弱悬殊难以完全对等协作的三重困境。区域法律治理中遵循效率原则、公平原则和正义原则,加强突出首都核心功能的区域文化遗产保护与利用的立法协同、加强京津冀区域文化遗产保护与利用的行政协同、加强京津冀区域文化遗产保护与利用的司法协同。
The legal governance of cultural heritage protection and utilization in Beijing-Tianjin-Hebei region with a collaboration view should endure the extracting functions which do not fit into the core functions of the capital.But there are three dilemmas that need to be solved as a whole. The first one is the uncertainty of regional legislation and scattered cultural heritage legislation. The second one is the order of solving urgent problems or long-term problems. The third one is an incomplete peer of heritage resource and its power of government. The cooperation legislation of Beijing-Tianjin-Hebei region for cultural heritage protection and utilization should abide by some rules,such as efficiency,fairness and justices rules. The legislation path should include regional collaboration so as to build laws which focus on the core-function of the capital,collaboration on administrative law enforcement and collaboration on regional judicial.
