摘要：中世纪德国在欧洲集市、贸易与城市高度契合的基础上呈现出强大的后发优势与特色,形成能够流传至今的集市、商业贸易和中世纪商人法体系。莱茵同盟、士瓦本同盟和汉萨同盟等德国商业同盟的形成也昭示了其集市、商业力量和商法的发达。中世纪德国集市法与商法关系密切,体现出教权和王权管理的垂直性以及商人交易和争议解决的平等性,出现了商事条约与商业领事等国际商法制度的雏形,为近现代商法制度的传承奠定了基础,并为德国商事单行法和商法典制定开启了序幕。德国在商人法立法和民商分立法典化过程中成为大陆法系的两大支柱之一,中世纪商人法承袭与变异后的经济法研究和立法也呈现出世界领先优势。
Based on the high combination of European fair,trade and city,medieval Germany showed strong advantages and characteristics of late-comer,and formed a system of fair,commercial trade and medieval merchant law that can be handed down to the present.The formation of German commercial alliances such as the Rhine League,the Swaben League and the Hanseatic League also indicated the development of its fair,commercial power and commercial law.The fair law and commercial law of medieval Germany are closely related,which reflected the magisterium and the verticality of power management and merchant trading and equality in dispute resolution,formed the rudiment of international commercial law system such as commercial treaty and commercial consul,laid a strong gene and foundation for the inheritance of modern commercial law system,and opened the prelude to the formulation of commercial law and commercial code of Germany.Germany became one of the two pillars of the civil law system in the process of merchant law legislation and the codification of civil and commercial separation.The research and legislation of economic law after the inheritance and variation of medieval merchant law also showed a global leading advantage.
