摘要：公务员职务犯罪,属执法犯法,亵渎了公权力,社会危害性极大,应予严惩。但由于刑罚种类单一、司法裁量权过大等原因,职务犯罪缓刑免刑率畸高,造成了不良的社会影响。职务犯罪分子动辄缓免刑,除欲逃脱刑罚制裁外,更重要的目的是企图保留公职。因此,我们需要借鉴古今相关立法,设置剥夺其担任公职权利的资格刑,实现罚当其罪,从而更加有效地遏制职务犯罪,促进廉政建设。
The civil servants＇ duty-related crimes deserve severe punishments, for they break the laws as law enforcers and blaspheme the public power, which is a great hazard to society. However, due to fewer types of penalty and too much judiciary discretionary power, the rates of probation and exempt from punish- ment of duty-related crimes are abnormally high, resulting in undesirable social impact. The easy probation and exempt of duty criminals leads to the criminals＇ escape from penalty sanctions; besides, the more impor- tant purpose is their intention to reserve the public employment. Therefore, we need to draw from the legisla- tion in the past and present, establish the punishment against qualifications for public office, make appropriate penalty according to their crimes. In this way, the duty-related crimes will be prevented effectively and the construction of incorruptible government will be enhanced.
