摘要：投保人未如实告知的,保险人可以争议保险合同的有效性。但是,保险立法例对于保险人争议保险合同的有效性的权利从多个角度附加限制,包括但不限于可争议事由、可争议期间以及保险人放弃权利等制度设计。保险法有关合同可争议的规范作为强行法,为保护被保险人的利益而存在,更为限制保险人解除合同的权利而存在。保险立法例因为所处的法律环境和制度结构体系的差异,保险合同的可争议制度在规范内容和结构、可争议事由、可争议期间与弃权制度发生作用的空间等方面存在差异。我国《保险法》第16条对保险合同可争议制度已有体系化的规范安排,但在制度运行的基础和逻辑层面,尤其是有关可争议期间的制度,是否如同我国学者所普遍认为的那样借鉴吸收了普通法系的不可争议条款的立法经验,在比较研究后则多有不同的结论。
An insurer may contest the validity of an insurance contract in case of the in- surance proposer＇ s false representation. However, in regard to the right to contest the validity of an insurance contract, due to differences of legal environment and institutional structure, insur- ance legislation has placed additional conditions from a number of angles, including but not limit- ed to the regulated content and structure, contestable grounds, contestable time period, and situa- tion in which waiver and estoppel shall apply. In order to protect the rights and interests of the in- sured, and to limit insurer＇ s right to terminate insurance contract, provisions relating to the cont- estability of the contract set forth by insurance law are compulsory. Article 16 of Chinese Insur- ance Law has established a norm regarding the system of contestability of the invalidity of insur- ance contract. Nevertheless, at the level of the basis and logic of the institutional operation, espe- cially in terms of contestable time period, whether we have drawn legislative experience in regard to the incontestability clause practiced Chinese scholars, leads to varied concl by usi common law countries, as it is generally believed by ons after comparative studies
