摘要:农村集体土地腾退是限于当时法律框架下介于征收和入市之间、满足城市急速扩张用地需求的一种折中选择。以北京地区法院的107件裁判文书为样本研究,法院基本的裁判逻辑是:总体上以村民自治为核心,认定腾退案件的性质,尊重村民自治决议的效力;法院依职权探知真实,采取优势证据的证明标准,综合其他证据认定行政自认的效力;土地腾退补偿尊重历史传承,兼顾现代社会发展因素,侧重生存权保障。《民法典》确立的集体经营性建设用地入市将面对类似的冲突,建议法院完善以下裁判规则:对村民自治区分“村民利益”与“村民共同利益”、个体的“事实判断”与团体的“事务决策”;对决议效力瑕疵采取“三分法”;异议村民通过四种诉讼进行权利救济;腾退补偿须兼顾土地发展权保障;通过司法建议发挥能动职能,加强诉源治理,规范行政指导村民自治等。
Rural collective land withdrawal was a compromise between expropriation and market entry under the legal framework at that time to meet the rapid expansion of urban land demand.Taking 107 judgment documents of Beijing District Court as samples,the basic logic of legal reasoning is:the court takes the villagers’autonomy as the core in the trials,identifies the nature of the withdrawal agreements,and recognizes the effectiveness of the villagers’autonomy resolutions.The court explores the truth according to its authority,comprehensively determines the effectiveness of the administrative self-recognition of other evidence,and adopts the proof standard of superior evidence.The compensation for land withdrawal respects the historical heritage,considers the factors of modern social development,and focuses on protecting the right of existence.The collective operating construction land established by the Civil Code will face similar conflicts when entering the market.It is recommended that the court should improve the following rules of adjudication:distinguishing“villagers’interests”from“villagers’common interests,”individual“fact judgment”from group“decision making”in terms of villagers’autonomy;adopting the“three-part method”for the defects of resolution effectiveness.The dissenting villagers could carry out right relief through four kinds of litigation.Tenure compensation should consider the protection of land development rights.Through judicial suggestions,we can play a proactive role,strengthen the governance of the litigation sources,and standardize the administrative guidance of villagers’autonomy.
