摘要:京津冀协同发展需要良好的法制环境,但现阶段区域合作处于较为松散的阶段,地方性法规之间存在相互冲突的问题,不利于区域内各种生产要素的自由流动,也阻碍了三地协同发展的进程。通过从京津冀的环境、经济与社会发展现状出发,分析目前三地协同发展的影响因素,主要是地方政府利益诉求方面的差异、制度设计和政策的倾斜抑制京津冀协同发展的步伐、缺乏公平的利益表达机制影响了沟通渠道中传递信息的代表性等。为京津冀协同发展提供法律保障是一项系统工程,不仅需要在立法层面上建立高屋建瓴的立法合作机制,制定《京津冀协同发展促进法》,还需要签订行政协议与加强执法监督,并进行三地的司法协助。
Although great attention has been paid to the Beijing-Tianjin-Hebei collaborative development by the Party and national leaders,there are still challenges of some kinds. The industrial structure varies significantly in the three areas,thus making it difficult for the industries in these three areas to positively interact with one another.The gap between the levels of development in the three areas is very big; there is no collaborative governance mechanism to go by,and there is no legal protection to make it easy for the three areas to get along with each other.It is,therefore,necessary to establish an interest-coordinated mechanism,and to set up a legislative coordination system. The three areas also need to support each other at an enforcement of law across the areas.
