摘要：日本自上世纪城市开发过程中,在公共用地取得方面积累了丰富的立法、学说和判例。本文从公共用地取得的任意性与强制性、公共利益认定的渐进性与多元性、损失补偿的公益性与私益性三个方面,结合我国《土地管理法》进行探讨,以期为我国农村集体土地征收制度的完善和具体实施提供镜鉴。
Japan has accumulated abundant legislations,legal theories and judicial precedents from the acquisition of public land in the course of urban development in the last century.To promote the expropriation system of rural collective land in China,this paper discusses three issues of the new land management law regarding the arbitrariness and coercion of public land acquisition,the gradualness and plurality of public interest determination,and the compensation for public and private interests.
