摘要：企业在生产经营过程中保护环境是必须履行的社会责任。政府作为公共管理中的重要主体，应该在规制企业履行环境保护责任方面发挥重大作用。国外先进的企业环境责任经验，让我们清晰地认识到我们需要改进的方向，不仅要从企业环境法律责任出发，还要切实地考虑到企业环境道德责任，将他们有机地结合起来，找出一条最适合中国企业环境责任的发展之路。
Enterprises are responsible for protecting the environment in the course of production and management. In the meantime as the main executive organ of public management, the government ought to play an important role in regulating the fulfillment of enterprises＇ responsibility of environmental protection. The present situation is not optimistic as for the actual performance of Chinese enterprises. In recent years, our government has made much progress in the regulation. However, that is not enough. This paper is summed up in the advanced foreign experience in corporate environmental responsibility, but also on China＇s current focus on corporate environmental responsibility into the relevant provisions and organize, to find our foreign advanced and the gap between the policy and thus more clearly We recognize the need to improve the area and the way forward, not only from the legal liability of the business environment, but also to consider the moral responsibility to the corporate environment. They will be organically integrated, to identify the most suitable for China＇s business environment responsibility for the development.
