摘要:宅基地使用权的收回会导致农户用益物权的消灭,应当严格规范收回的适用条件。《土地管理法》第66条规定了收回宅基地使用权的三项事由,下位规范将其细化为8项事由。实践中收回主要集中适用于“旧村改造”,其他事由极少适用,立法与实践脱节。需要对各项收回事由进行合法性乃至合宪性审查。另外,也要厘清宅基地使用权收回与征收、自愿有偿退出、违法用地处罚等宅基地管理制度的关系。在此基础上,可以将收回事由进行体系化重构:保留第1项乡村公益性收回并具体化其适用范围、收回程序和补偿标准;取消第2项未按照法律批准用途使用的收回;限缩适用第3项停用性收回,仅保留其中的两类,即农户消亡且无人继承宅基地上住宅及其附属设施的收回、经批准异地建房之后建新不拆旧的收回。
The recovery of homestead land use rights leads to the termination of farmers'usufructuary rights,which should be strictly regulated in terms of applicable conditions.Article 66 of the Land Administration Law stipulates three reasons for the recovery of homestead land use rights,which have been further detailed and expanded by subordinate laws into eight reasons.In practice,recovery is mainly concentrated in"old village renovation,"with other reasons rarely applied,indicating a disconnect between legislation and practice.It is necessary to conduct a legality and even constitutional review of various reasons for recovery.Additionally,it is essential to clarify the relationship between the recovery of homestead land use rights and other homestead land management systems,such as expropriation,voluntary compensated exit,and penalties for illegal land use.On this basis,the reasons for recovery should be systematically restructured:retain the first reason of recovery for rural public welfare and specify its scope of application,recovery procedures,and compensation standards;cancel the second reason of recovery for non-compliance with the legally approved use;limit the application of the third reason of discontinuance recovery to only two categories:recovery when the household ceases to exist and there is no heir to the residential buildings and their ancillary facilities on the homestead,and recovery when a new house is built elsewhere without demolishing the old one after approval.
