摘要：行政违法行为检察监督源于国家权力分工和制约,是依法行政的重要保障,彰显以人民为中心、公平正义的法治价值。在认识论角度,要厘清其与行政权、行政审判权、党纪监督和国家监察权的关系。行政违法行为检察监督实践中存在制度供给不明确不充分,在检察监督范围、案件线索和监督方式等方面形成的体系性操作困难,检察队伍建设薄弱等问题。在理论阐释基础上,综合现行法律制度与实践经验,提出如下完善路径:一是修改《检察院组织法》,增列行政违法行为检察监督职权;二是出台“行政违法行为检察监督规则”并做好顶层设计与发展规划,系统性地解决监督范围、案件线索来源以及监督方式等问题;三是从行政检察专门机构设置、加强专业能力建设及强化业务培训等方面,提升基层检察队伍建设水平。
Procuratorial supervision over administrative violations originates from the division and checks of state power,serving as a crucial guarantee for law-based administration and embodying the legal value of people-centered fairness and justice.From an epistemological perspective,it is necessary to clarify its relationships with administrative power,administrative judicial power,Party discipline supervision,and state supervision power.In practice,procuratorial supervision over administrative violations faces problems such as unclear and insufficient institutional supply,systematic operational difficulties regarding aspects like the scope of procuratorial supervision,case clues,and supervision methods,as well as weak development of the procuratorial team.Based on theoretical elaboration,integrating existing legal system and practical experience,the following improvement pathways are proposed:first,amend Organic Law of the People’s Procuratorates to add the power of procuratorial supervision over administrative violations;second,enact Rules on Procuratorial Supervision over Administrative Violations with comprehensive top-level design and development planning to systematically solve issues concerning the scope of supervision,sources of case clues,and supervision methods;third,enhance the development of grassroots procuratorial teams by optimizing the setup of specialized administrative procuratorial institutions,strengthening professional capacity building,and intensifying professional training.
