摘要：知识产权证券化是促进知识产权高效应用、解决中小企业融资难问题的有效途径,近年来在国内得到一定关注,但是相关的系统性研究还很少。本文首先对国家和地方层面的相关政策文件进行梳理,然后对国内外典型的知识产权证券化案例进行比较分析,在此基础上,提出一种中国情境下面向多个创新型中小企业组合、以专利权为底层资产的知识产权证券化典型模式,并对该模式的关键要素和关键问题进行探究,以期为中国知识产权证券化的实践发展和相关理论研究提供借鉴。
Intellectual property securitization is an effective way to promote the efficient application of intellectual property and solve the financing problem of small and medium-sized enterprises.In recent years,it has received some attention in China,but the related systematic research is still rare.This paper first combs the relevant policy documents at the national and local levels,and then makes a comparative analysis of typical cases of intellectual property securitization at home and abroad.On this basis,it puts forward a typical model of intellectual property securitization which combines multiple innovative SMEs and takes patent as the underlying asset under the Chinese scenario,and the key elements and key points of the model are discussed.This paper is expected to provide references for the practical development of intellectual property securitization and related theoretical research.
