摘要：焚书坑儒和党锢之祸中的士人皆因诽谤朝廷、散布妖言而被治罪。诽谤、妖言是秦汉时期言论犯罪的主要名目。由于士人的文化特质和社会地位,言论是他们干预政治的独特方法,当士人的言论超出了统治者所允许的范围时,就构成了犯罪。统治者的压制又影响了士人以言论参政的积极性,削弱了王朝的生命力。
The free press criminal of the scholar caused the burning books and pit of scholar and the disaster of party durance.Because the scholars had cultural idiosyncrasy,the free press was one of the special means to intervene the politics.When the free press was beyond the permission of the governor,they would be criminal.The pressing of the governor shocked the enthusiasm of them and impaired the life of the dynasty.
