摘要：文章通过对我国部分地区农村土地承包经营权流转现状的调研分析,发现其存在土地没有确权确证、地方政府强制干预、相关法律法规不完善等问题,这些都极易导致农户土地权益受损。政府部门应加快农村社会保障的建设、完成土地确证确权、完善法律法规、明确农户在流转过程中的主体地位,维护农民土地权益。
This paper analyzes the current situation of the transfer of rural land contractual manage- ment right in some areas of China by means of field questionnaires. There are some problems in land rights guarantee for farmers, including the lack of land right confirmation, the compulsory interven- tion of local government, the imperfect of relevant laws and regulations and so on, which are likely to lead to the damage of farmers＂ rights. Government departments should speed up the construction of rural social security, complete the confirmation of land ownership, improve the laws and regulations, clear the dominant position of farmers in the process of transfer, and safeguard the rights and interests of farmers.
