摘要：西方国家大多采用“权力分立”的国家治理模式。由于这一模式有着诸多弊端,我国经过试点后,通过2018年宪法修正案正式宣告采用“监察法治(国家监察)”的新治理模式。监察法治模式是基于中国人的实用理性思维和中国的传统文化并经由多年的权力监督实践而形成的。监察法治模式的完全建成,还有赖于保持监察实效的持续性并由此促进民众对监察的信仰生成。而这一切,归根结底在于中国共产党具有自我革命的特质。特别要注意,在国家治理上,权力监督和权力分工合作之间常常彼此对立,而监察法治能够有效化解这一困境。
Most of Western countries adopt the model of power separation in state governance.As this model has many defects,after conducting tests at selected points,China formally declared the adoption of the new model of state governance,“the rule of supervision law or national supervision”in the 2018 constitutional amendment.The new mode is deeply based on Chinese practical rational thinking and Chinese traditional culture,and finally has been formed through many years of practical supervision.The complete establishment of this new model depends on maintaining the sustainability of supervisory effectiveness and thus promoting the generation of people’s beliefs in state supervision.All this,in the final analysis,lies in the fact that the Communist Party of China has the characteristics of self-revolution.In addition,power supervision and power cooperation are practically often opposed to each other in state governance,however,the rule of supervision law can effectively resolve this dilemma.
