摘要：典当是市场经济条件下不可缺少的融资方式之一,随着我国经济发展典当行的经营范围在立法上已经发生了重大变化,而商业实践的丰富性则进一步突破《典当管理办法》的相关规定带来了诸多困扰。面对百姓的生活消费需求、中小企业旺盛的融资需求与有限的融资方式和融资渠道的矛盾,未来我国典当行业立法应坚持负面清单管理的法治理念,坚守"不得吸收公众存款"、"不得发放信用贷款"两条底线,适当扩展典当行的经营范围,这符合公司越围无效规则的基本法理和现代法制改革的发展趋势。此外,从尊重企业自治权利出发,科学界定典当行业的法律地位、完善典当行业的监督体制当属应解决的前置性问题。
Pawn is a kind of indispensable financing ways, and pawnbroking are quasi - financial institution, whose business scope has been changed significantly with the times and the economic development of China. The richness of business practice has broken obsession of current legislation. Facing the contradiction of strong financing demand of consumer and limited financing channels for small and medium sized enterprises, textual consider that the legislation in the future should conform the negative inventory management idea, keeping the bottom line that pawn may not draw on deposits of the general public and grant fiduciary loans, respect for enterprise autonomy and industry routines, reasonable define the border of government and market. This idea meets the basis theory of invalid skip over scope and management system of this industry should be promote it into an orderly working situation.
