摘要：作为官吏赃罪制裁手段,资格刑在中国有着悠久的历史。官吏犯赃是权力的滥用,对赃吏适用资格刑,剥夺其为官的权利,是中国古代重典治吏、权力制约的重要环节。传统法律之官吏赃罪资格刑,是蕴含着官德要求的刑罚,即以德作为权力制约的内在支撑,以刑作为权力制约的外在手段,是一种儒法结合的权力制约措施。资格刑对遏制官吏犯赃、打击贪官污吏、保证吏治清明、弘扬优良社会风气、稳定社会秩序等,皆有不可忽视的积极作用。考察传统法律之官吏赃罪资格刑,可获得有益的借鉴与启示。
Being sanctions against official crimes of taking bribes, qualifications punishment has a long history in China. Taking bribes is the crime of abuse of power. Applying qualifications punishment to corrupt officials, depriving their right of staying in officialdom, is an important link of the power restriction.Qualifications punishment is the penalty that emphasizes official ethics, is the power restriction measure that combines Confucianism and Legalism. It means that virtue is internal support of the power restriction, penalty is external measure of the power restriction. Qualifications punishment can play positive role in preventing official crimes of taking bribes,combating corrupt officials, ensuring officialdom honest and upright, promoting good social atmosphere, stabilizing social order. By studying traditional law＇s qualifications punishment, we can get useful reference and enlightenment.
