摘要：本文以教育部2016年出台的《普通学校资源教室建设指南》为例,论述了特殊教育政策、法律支持的应然转变。认为,包括随班就读在内的特殊教育的政策支持应该转变到法律支持,强调法律条文应由宏观转变为具体,如特殊教育对象的类别、特殊教育对象的鉴别、特殊教育经费的拨付等应有详细的法律规定,并且提出要在特殊教育法律的条文中引入法律实施过程的评鉴和罚则,以真正督促特殊教育的发展。
This paper is focused on the change of special education policy and legal support after the Construction Guides of Re- sources Room in Ordinary schools was issued by Ministry of Education of the People＇s Republic of China in 2016. We thought that the policy support of learning in regular class of special education must be undertaken by law. In particular, the articles of law on special education should be changed from the macroscopic statement to the concrete clause, for example, the classification, the i- dentification of the object of special education and the budget of special education should be specified in detail. Finally, the au- thor proposed that there should be articles of law about the evaluation of law enforcement and the oenal clause.
